1. Introduction

Welcome to GetAdvice.ai ("Service"), a tool that allows users to create AI-powered advisory boards. The Service is owned and operated by Optivian Solutions Oy ("Company", "we", "us", "our").

By accessing or using GetAdvice.ai, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Beta Status and Token Limits

You acknowledge that the Service is currently in a Beta/Testing phase.

  • "As Is": The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be error-free or uninterrupted.
  • Token Limits: The Service is currently free to use but operates under specific token (usage) limits. Once your account reaches this limit, the Service will cease to function until limits are reset or expanded at our sole discretion.
  • Future Pricing: We reserve the right to introduce pricing, subscription fees, or change the usage limits at any time with reasonable notice.

3. Nature of AI Services

The Service uses Artificial Intelligence (AI) to generate text and simulate conversations with personas modeled after experts.

  • Simulation Only: The "Advisors" are AI simulations. They are not real people, and they do not represent the actual opinions, beliefs, or advice of the real-world individuals they may be modeled after.
  • No Professional Advice: The content generated by the Service is for informational and brainstorming purposes only. It does not constitute professional legal, financial, medical, or strategic advice. You should not make significant life or business decisions based solely on the AI's output.
  • Accuracy: AI models can "hallucinate" (generate false information). You are responsible for verifying any facts or claims made by the Service.

4. User Responsibilities

When using the Service, you agree:

  • IMPORTANT - Confidential Information: You acknowledge that the Service processes your inputs through third-party AI providers. DO NOT input any confidential, proprietary, or sensitive information including but not limited to: trade secrets, proprietary algorithms, API keys, passwords, financial secrets, confidential business strategies, personal data of third parties, or any information you are legally obligated to keep confidential. If you choose to input such information, you do so entirely at your own risk, and the Company assumes no liability whatsoever for any disclosure, exposure, or loss of such information.
  • Not to use the Service for any illegal or unauthorized purpose.
  • You represent that you have the right to use any text or context you input into the Service.
  • Not to copy, reproduce, modify, or create derivative works based on the Service or any part thereof.
  • Not to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of the Service.
  • Not to rent, lease, sell, resell, sublicense, or otherwise transfer rights to the Service.
  • Not to use any automated system, including bots or scrapers, to access or extract data from the Service.

5. Intellectual Property

  • Your Content: You retain ownership of the inputs you provide and the outputs generated for you by the Service. You grant us a license to process this data solely to provide the Service.
  • Our IP: Optivian Solutions Oy retains all rights, title, and interest in the GetAdvice.ai platform, code, design, and methodology.

6. No Security Warranty

The Service is provided without any warranty of security. While we implement reasonable security measures, we do not guarantee that the Service will be free from vulnerabilities, security breaches, or unauthorized access.

  • You acknowledge the inherent risks of cloud-based AI services and data transmission over the internet.
  • We are not responsible for the security of data transmitted to or processed by third-party AI service providers.
  • You accept that no data transmission or storage system can be guaranteed to be 100% secure.

7. Indemnification

You agree to indemnify, defend, and hold harmless Optivian Solutions Oy, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your violation of these Terms.
  • Your use of the Service.
  • Any content you input into the Service.
  • Any confidential or proprietary information you chose to input into the Service.
  • Any claims by third parties arising from your use of the Service.

8. Limitation of Liability

To the maximum extent permitted by applicable law (including Finnish Consumer Protection laws where applicable), Optivian Solutions Oy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from:

  • Your use or inability to use the Service.
  • Any decisions you make based on the AI's advice.
  • Unauthorized access to or use of our servers and/or any personal information stored therein.
  • Loss, exposure, or disclosure of any confidential or proprietary information you input into the Service.
  • Any claims related to data security breaches.
  • Actions, omissions, or data handling by third-party AI service providers.

In no event shall our aggregate liability exceed the amount you paid to us, if any, for the Service in the past six months.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Finland. Any disputes relating to these Terms will be subject to the exclusive jurisdiction of the courts of Helsinki, Finland.
