2. Information We Collect
We collect information to provide and improve the Service:
- Account Information: If you sign up, we collect your email address and authentication credentials.
- Usage Data: We collect logs, timestamps, and device information to monitor the stability and performance of the Beta application.
- Content Data: We process the text inputs (prompts) and attachments you submit to the AI and the text outputs generated by the Service to facilitate the "shared memory" feature of the board.
3. How We Use Your Information
- To Provide the Service: To generate AI responses, maintain conversation history, and manage token usage limits.
- To Improve the Service: To analyze usage patterns and fix bugs during this Beta phase.
- Communication: To send you updates regarding service changes, token limit resets, or future pricing information.
4. AI and Third-Party Sub-processors
To provide the AI functionality, we utilize third-party Large Language Model (LLM) providers (e.g., Google, OpenAI, Anthropic, or similar APIs).
- Your inputs are sent to these third-party providers solely for the purpose of generating a response.
- We only use LLM providers that do not use customer data for training their models.
- While we select providers with strong privacy practices, your data is processed through their systems and their data handling policies apply during processing.
- We do not sell your data to third parties.
5. Legal Basis for Processing (GDPR)
We process your personal data under the following legal bases:
- Contract: To fulfill our agreement to provide the Service to you (Terms of Service).
- Legitimate Interest: To secure and improve our services.
- Consent: For any optional marketing communications.
6. Data Storage and Transfers
The Service is hosted on servers that may be located within the EU/EEA or USA and utilized by US-based providers (like LLM APIs) that adhere to standard contractual clauses or the EU-US Data Privacy Framework.
7. Data Retention
We retain your data for a reasonable period necessary to provide the Service and fulfill the purposes outlined in this policy. When you or your workspace administrator deletes data, we remove it from our systems within a reasonable timeframe.
Please note that data processed by third-party LLM providers may be subject to their own retention policies for transient processing logs, which are outside our control.
8. Workspace and Data Deletion
- Workspace Administrators can permanently delete their entire workspace from the Settings page. This removes all associated data including users, sessions, messages, advisors, and configurations.
- Individual Users can request deletion of their personal data by contacting us at legal@optivian.ai.
- Upon deletion request, data is removed from our systems within a reasonable timeframe. We cannot guarantee removal of data from third-party LLM providers' transient processing logs.
9. Security Measures and Limitations
We implement reasonable technical and organizational measures to protect your data. However:
- No system can be guaranteed to be 100% secure.
- You accept the inherent risks of transmitting data over the internet.
- We are not responsible for security incidents caused by third-party providers or factors outside our reasonable control.
10. Your Rights
Under the GDPR, you have the right to:
- Access the personal data we hold about you.
- Request correction of inaccurate data.
- Request deletion of your data ("Right to be Forgotten").
- Object to processing.
